Viera's age-restricted communities compared from public records, what the 55+ rule actually requires, and what to ask before you buy. Updated October 2026.
Florida's fair housing law has rules on familial status, meaning households with children, and housing for older persons is exempt from them (Florida Statutes 760.29(4)). A community intended for people 55 and older gets that exemption only when it meets all three of these tests:
The law sets a floor for the community as a whole. The details, like whether anyone younger may live in a home and how ages get checked, are in each community's own declaration and rules.
Florida used to have these communities register with the Florida Commission on Human Relations. The Legislature dropped that requirement in 2020, so there's no state list to look one up on. The community's own documents are what to check.
These are the Viera communities whose own association rules or developer state the 55+ rule. Heritage Isle's association rules apply it across the Heritage Isle district and make the District Association responsible for keeping it. PulteGroup and The Viera Company both describe Del Webb at Viera as a 55+ community. Lennar's sales pages for Bridgewater at Viera described it the same way.
Here they are from the tax roll, oldest first. Each name opens that community's own page, with lot sizes, price bands and more.
| Community | Homes on the tax roll | Built | Median total area | Sales since 2022 | Median sale |
|---|---|---|---|---|---|
| Heritage Isle | 1,599 | 2004 to 2017 | 2,545 sq ft | 125 | $382,500 |
| Bridgewater | 860 | 2018 to 2023 | 2,632 sq ft | 72 | $520,000 |
| Del Webb | 503 | 2023 to 2025 | 2,754 sq ft | 198 | $542,550 |
Homes, years, sizes and sale prices come from the Florida Department of Revenue tax roll for Brevard County. Public records lag the live market, so read them as the shape of each community and ask us for current comps. Square footage is the tax roll's total area, which can include the garage and porches, so it runs higher than the living area on a listing.
The tax roll can't tell you what a home costs to own in one of these communities, or what you're allowed to do with it. Get those answers from the association's documents, not from a listing description:
For Heritage Isle, the Heritage Isle at Viera Community Development District posts its adopted budget and assessment schedule at heritageisleatvieracdd.org.
Ask for the declaration, the rules and the current budget before you make an offer, or as early as your contract allows. We can help you request them.
General information, not legal advice. Each community's declaration and rules decide how its age restriction works, so read them for the home you're considering. Heritage Isle, Bridgewater and Del Webb are the Viera communities whose own association rules or developer state the 55+ rule. Together they have 2,962 homes on the Brevard County tax roll, and each has its own page on this site with sales since 2022.
Under Florida Statutes 760.29(4), at least 80% of a community's occupied homes must have at least one resident 55 or older, the community must publish and follow policies showing it's intended for people 55 and older, and it must verify ages under federal HUD rules.
The law sets a floor for the whole community, not a rule for each sale. Whether a younger buyer may own or live in a home is up to that community's declaration and rules, so ask the association before you make an offer.
